Woman Left Handcuffed by Police in Pathway of Oncoming Train

Although police officers have the authority to use force when making arrests, they are still responsible for the safety of suspects. When suspects are harmed while in police custody, serious questions may be raised about whether the police acted in a negligent manner. This is especially true when you consider the fact that a handcuffed individual is completely defenseless. But what happens when the police leave a suspect confined in the pathway of an oncoming train? What happens if the train then hits them in Pennsylvania? Could this form the basis of a lawsuit?

A Stunning Example of Police Misconduct

On September 27th, NBC Philadelphia reported that a 20-year-old woman had been left inside a police car while handcuffed – forced to watch helplessly as a train came closer and closer. By the time the police officers realized what was going to happen, it was already too late. In a video that has now gone viral, the police car was struck by the train at full speed with the woman still inside. According to various reports, she has suffered a range of injuries, including nine broken ribs, a broken arm, and a fractured sternum.

It’s not clear why the police officers decided to stop their vehicle on the train tracks. We do know, however, that they were preoccupied with searching the suspect’s vehicle when the train collided with the patrol car. You can also clearly hear a train horn blaring multiple times in the viral video – a warning sign that the police officers seem to have completely ignored.

The woman plans to sue the police for what she believes is a clear case of negligence. Her attorney has already described the police officers’ actions as “indescribable” and “irresponsible.” No formal charges have been laid against the police officers, but at least one of the individuals involved has been placed on administrative leave.

Other Instances of Police Negligence

There are many other examples of police negligence. On October 8th, it was reported that a police chase in Milwaukee had left three people dead – including an innocent pedestrian who was seriously injured. On October 7th, it was reported that a police chase in the Bronx had left 10 people injured – including two innocent children.
